By accessing the content, services and subscriptions on Stayoo website through any of the device or platform and also by completing the registration and subscribing to our services , we learn that you’ve acknowledged and agreed to have read, understood the terms and conditions adopted below including the privacy, booking and cancellations policies.

This website is an online platform that has a list of various types of properties offered by Host (the host may be the property owner or a property manager or the one who is authorized as a property manager or an agent of the property’s actual owner or other stay accommodation provider).

Host and Guest both are the registered users of this Website.

Scope of our Service:

Stayoo act solely as an intermediary between Guests and the Hosts, virtually to receive and transmit the information provided by the host and by the Guest. While, doing so, the information provided by the Guest and the Host only is disclosed. Hence, you hold the responsibility to check the information, the correctness and the accuracy of the listing, price and terms and conditions.

Stayoo will use reasonable skill and technology to monitor and control accommodation listings. We will not hold any responsibility for any incorrect, irrelevant, misleading, untrue, errors, mistakes in the listing information or any unexpected application errors, upgrades and maintenance on our website.

Though, our services will make reliability check of each listing, our website should not be considered as an authority, and should not be considered as a recommendation or endorsement with respect to the property, rate, availability, quality, service level and review of the listings available.

No use of the portal for commercial purposes:

Stayoo holds complete authority to monitor the use of the website. If any suspicious, illegal or disturbing activities are found, we will block your account in such cases.

Using the Stayoo brand name is allowed only when you have prior permission from our authorities. Legal action will be taken against any sort of illegal framing or linking from our website.

Stayoo does not encourage creating multiple Guest accounts. If it was found, we will deactivate all the suspected or detected accounts.

This platform cannot be used for buying or selling of any product or service. Guests of this portal should not be sent with any chain letter or junk email. Though it is not practically possible for monitoring Guest actions of our website, violation of this rule is punishable. To prevent such activities, we allow only minimal communications, profile contacts and responses in our portal.

Stayoo does not allow the use of automated processes like IRC Bots, EXE’s CGI, or other programs or scripts to view any content, communication, contact, or any other interactions made with our members.

Stayoo takes complete rights to take overall control of all communications and messages made in our portal. We hold the right to monitor each one of them, and can delete the same when it is found obscene or void.

Account security and password:

To make use of the offers and services with Stayoo you are bound to stay responsible of maintaining secrecy of your username and passwords. It is your sole responsibility for all activities performed in your account.

Stayoo will make sure to keep all user credentials confidential. In any case of leakage of passwords, or intrusion into the user account by a third party, Stayoo will not be responsible by anyway. In case of identification of any unauthorized usage of user account, the respective user should get in touch with the concerned official at Stayoo and keep informed about such activities.

Posts made on the website:

As a Stayoo Host and Guest, you comply with our terms that any content, image or post that is offensive, illegal, or that violates the rules, bringing harm to others, or threatening others will be removed by Stayoo.

Content submitted for inclusion on our portal including contact details are unconditionally and irrevocably granted for usage, reproduction, modification, posting and displaying on the website and share with other members of Stayoo as required from time to time.

Any information shared or made available with Stayoo – be it your name, photograph, contact details, messages, tags, content, etc – either publicly or through private communication, falls under your sole responsibility at your own risk and possible consequences. In other words, it is you who have to take complete responsibility of all information shared with the portal. We neither have any restrictions on the content posted on Stayoo nor guarantee for accuracy, quality or integrity. We under no circumstance will be bound to be liable for any content inclusion, omission, loss or damage of any kind incurred due to content postings made with Stayoo.

Any content published or displayed on the website it is your sole responsibility. We hold only the right to cross check the authenticity of content posted by you. As a step to verify the content postings made by you, you may be requested to provide necessary documents as evidence. If you fail to provide the requested documents, we take our discretion to terminate your account with us.

By making your Post on our website, you agree to grant permission and provide complete rights to make use of the content of any of our derivative works, and other works or information incorporating the content. The permission granted is irrevocable, perpetual and a license for copying, using, performing, distributing or displaying of the content update that was made.

Following is a list of content that are not allowed to be published on our website. We consider it illegal and prohibit updating the content of this kind. Investigations will be made and necessary legal actions will be taken against the members who violate the agreement. We hold the rights to terminate your account in this case of prohibitive content update.

  • Any content that is offensive to a particular community. A content that helps to promote racism, bigotry, feel of hate or any kind of physical harm opposing a specific group or one separate individuals

  • Any content that harasses another person

  • Content that transmits junk mail, chain letters or other types of spamming or unsolicited mass mailing

  • Content that helps the promotion of false information or illegal activities. Abusive, threatening, defamatory, libellous or obscene content are prohibited

  • Piracies in content are not allowed. Promoting methods of piracy, making use of computer programs for circumventing copy-protected devices of manufacturers, publishing pirated music or web links to pirated music, etc are not allowed

  • Any content containing restricted or password protected access, or the ones containing hidden pages or images are prohibited

  • Content that exploits anyone below 18 years of age in a violent manner, or the ones intended to solicit personal information of anyone below 18 years of age are strictly prohibited

  • Content update about illegal activities like buying illegal weapons, methods to violate piracy, details about creating computer viruses, etc are prohibited

  • Soliciting passwords or other personal information to perform unlawful or commercial procedures from others

  • Engaging in commercial activities without written consent to participate in sweepstakes, contests, advertising, pyramid schemes or barter are not allowed

  • You are not allowed to include in profile anyone else details of contact numbers, address, website and email address that are made visible to you.

Stayoo users are bound to use the portal complying with the State laws, rules and regulations which are in use.

Property listings:

Hostis bound to take complete responsibility of all property listings made on the Stayoo portal. While creating a listing, information about the location, capacity, size, amenities, price, security deposits, applicable tax rates and financial terms are to be submitted in the listing. Accommodation address shall be a physical address with detailed pin code.

Any liability arising out of alleged accuracy, reviews about the property, guest book entries, or breaches of contract on the host’s side will be disclaimed by Stayoo. The host should remain responsible of keeping their property information updated which is inclusive of but not limited to specific or all property representations, amenities, location, pricing, availability during a specific date, reservation and cancellation policies, payments and refund policies, etc.

Stayoo never provide any warranty for your content, property reviews, guest book entries, location of the property, suitability, price details, information about availability, etc published on Stayoo are accurate or kept up-to-date even when potential travellers search for specific offers, property types or dates. It is the Host’s sole responsibility to maintain the accuracy of property descriptions, and it is the Guest’s sole responsibility to verify the accuracy of these descriptions.

As a Host you acknowledge and agree that you are responsible for thelistings you post. Accordingly, you represent and warrant that you will not breach any agreements you have entered into with any other third parties, the legal title owner of the property listed.

Host shall also comply with all local applicable rules, acts, laws and taxes applicable. Host shall not conflict with the rights of 3rd party agreements if any such exists.

Stayoo does not act as your contracting agent. If a Guest requests a booking of your accommodation, any agreement you enter into with such Guest is between you and the Guest. Stayoo is not a party in the agreement.

Bookings and Financial Terms

Stayoo does not determine or fix the rates and charges of the property listed. Rates and Service charges are fixed by the Host and local Taxes are applicable according tothe local State Law.

You shall pay the full fees towards the booking upon confirmation of the requested booking by the applicable host. On receiving confirmation for your booking from the respective host, Stayoo will get the fees as per the terms and pricing terms fixed by the Host. Every guest agrees to accept Stayoo as a limited agent appointed by the host solely intended for collecting payment on behalf of the host. Every Guest also accepts that Stayoo would claim no liability for any acts or omissions of the host.

Payments made by Guests shall be considered as direct payment to the Host. Hence, Host shall adhere to the accommodation provision as per the listing and bookings. Otherwise, Host is required to either confirm or reject the booking request within the Booking Request Period; else the requested booking will be automatically cancelled. If a requested booking is cancelled and if any payment is made to Stayoo, Stayoo holds the right to refund the payment to Guests.

Guest requested bookings and payment process may pop up asking for personal details such as name, billing address and credit card details by our authorized payment gateways. In such case, you must furnish the necessary details to complete the payment process. You may also refer to the terms and conditions and any transaction charges as applicable. Upon completing the payment process, please verify the transaction receipt and confirm the successful status of the transaction and amount details.

Cancellation and refunds

By making a reservation with Host, Guest must accept and agree to the relevant cancellation and no show policy of that Host, and to any other additional terms and conditions of the Host that may apply to your reservation during your stay, including for services rendered and/or products offered by the Host. Host’s general cancellation and no show policy may be referred on the Host’s website or on the accommodation listing page, also during the reservation procedure and in the confirmation email.

Please check the property details thoroughly prior to making your reservation. Some Hosts may require a down payment as an advance or full payment, please check the refund policy the Host before making the reservation. Note that certain Host may have special offers, otherwise in general bookings are not eligible for cancellation, reschedule or to do any other changes.

Guest shall not be entitled to any refund for any wrong payments of invalid transactions, unless the Host refund policy allowed doing so. Host may have provisions for the refund policy, if the cancellation is made 3 days prior to the actual date of stay. The amount to be refunded to the guest will be deducted of the total price of booking by 25 per cent, and not the actual price originally paid would be refunded. Such refund process is the responsibility of the Host’s. Note that such refund process may take many working days/weeks to reflect in your bank account or credit card statements, due to the process involved. We will not be responsible for any such delays either by the Host or respective Host’s bank process.

Guest may be able to review and reschedule or cancel the reservation, which if stated in part of their reservation confirmation email. You may refer the same and revert to the host and follow the instructions therein.

Recurrence in payment:

When guests opt to stay in an accommodation that is categorized under long-term stay, they will have to make recurring payment. Guests will be notified at the time of submitting the booking request in case if the property belongs to a long-term stay category. In case of such long-term stay bookings, guests, whenever they get the payment due, should log into their Stayoo account and follow the sequence of payment procedures. Stayoo will keep you informed about the payment schedule right at the time of booking confirmation. The Guest shall make the recurring payment without any objection on or before the payment due date.

Payment Processing Errors:

Stayoo will work closely with the payment gateways and monitor the transactions. If any transactions are reported and witnessed, Stayoo will take steps to rectify any payment processing errors. The process may take several days to weeks of time according to your bank procedures. You may also call the customer care number of your bank to lodge the error if required.

Taxes:

Tax regulations such as service, luxury tax or any other taxes shall be disclosed as part of the listing information and to be included to reach the total price by the Host. These taxes may vary according to the origin of the Host and applicable local State laws. In turn, Guest must pay the total price including taxes as compulsory. Host shall remit such taxes back to the local authorities and exchange such invoice copies if requested by the Guests.

Damage to Accommodations:

Stayoo is not responsible for any damages that occur during the stay of the Guest. Guests shall be responsible for taking responsibility of the assets of the property and restrain from making any damages. In the event of any damages occurring due to negligence or any other reason by the Guest. Guest must compensate for such damages, or negotiate with the Hosts and settle the damages. Guest shall co-operate if any insurance claims are applicable by the property insurance cover.

Foreign Currency:

Stayoo provides services in many international countries. Hence, each Guest must pay to Host either by direct currency or through conversion. You must be aware that such process may contain currency conversion and exchange service charges. The cost may reflect on both the Host and Guest, which includes type of payment methods and charges applicable by your financial provider.

Suspension, Termination and Stayoo Account Cancellation:

We may, in our discretion and without liability to you, with or without cause, with or without prior notice and at any time, decide to limit, suspend, deactivate or cancel your Stayoo Account. If we exercise our discretion under these Terms to do so, any or all of the following can occur with or without prior notice or explanation to you: (a) your Stayoo Account will be deactivated or suspended, your password will be disabled, and you will not be able to access the Site, Application, Services, your Stayoo Account, your Member Content, or receive assistance from Stayoo Customer Service, (b) any pending or accepted future bookings as either Host or Guest will be immediately terminated, (c) we may communicate to your Guests or Hosts that a potential or confirmed booking has been cancelled, (d) we may refund your Guests in full for any and all confirmed reservations, irrespective of pre-existing cancellation policies, (e) we may contact your Guests to inform them about potential alternate Accommodations with other Hosts that may be available on the Site, Application and Services, and (f) you will not be entitled to any compensation for reservations or bookings (even if confirmed) that were cancelled as a result of a suspension, deactivation or termination of your Stayoo Account. You may cancel your Stayoo Account at any time by sending an email via contact us page. Please note that if your Stayoo Account is cancelled, we do not have an obligation to delete or return to you any content you have posted to the website, application and services, including, but not limited to, any reviews or Feedback.

Limitation of Liability:

YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, SERVICE AND CONTENT, YOUR LISTING, AS A HOST, A LISTING YOU ACT AS AN AUHTORISED REPRESENTATIVE OR YOU ARE INQUIRING AS A GUEST AND ANY CONTACT YOU HAVE WITH OTHER USERS OF Stayoo WHETHER IN PERSON OR ONLINE REMAINS WITH YOU.

Reporting Misconduct:

If anyone whom you feel is acting or has acted inappropriately, including but not limited to anyone who (I) engages in offensive, violent or sexually inappropriate behaviour, (ii) you suspect of stealing from you, or (iii) engages in any other disturbing conduct, you should immediately report such person to the appropriate authorities like the local Police Station, Cybercrime or any other applicable authority. You shall also communicate the details with Stayoo using the contact details provided in contact us page or by writing an email or posting it to the physical address of Stayoo office, provided that your report will not obligate Stayoo to take any action beyond that required by law if any or does not cause us to incur any liability to you.

Entire Agreement:

These terms and conditions constitute the entire and exclusive understanding and agreement between Stayoo and you regarding the Site, Application, Services, Content, Referral Program, and any Listings and Bookings of Accommodations made via the Site. These Terms and Conditions supersede and replace any and all prior oral or written understandings or agreements between Stayoo and you regarding the Site, Application, Services, Content, Referral Program, and any Listings and Bookings of Accommodations made via the Site.

Assignment:

You may not assign or transfer these Terms and Conditions, by operation of law or otherwise, without Stayoo prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be void, null and shall have no effect. Stayoo may assign or transfer these Terms and Conditions, at its sole discretion, without restriction. Subject to the foregoing, these Terms and Conditions will bind and inure to the benefit of the parties, their successors and permitted assigns.

Notices:

Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms and Conditions, will be in writing and given by Stayoo (i) via email (in each case to the address that you provide) or (ii) by posting to the Site or via the Application. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.

Controlling Law and Jurisdiction:

These Terms will be interpreted in accordance with the laws of the Government of Tamil Nadu and the Government of India, without regard to its conflict of law provisions. You and we agree to submit to the personal jurisdiction of a District Court located in Chennai District for any contract discrepancies and conflicts for which we the parties confirm here the right to seek injunctive or other equitable relief in court of competent jurisdiction.

Indemnification:

YOU AGREE TO INDEMNIFY AND HOLD Stayoo, ITS SHAREHOLDERS, DIRECTORS, AFFILIATES, OFFICERS, AGENTS AND EMPLOYEES, LICENSORS AND ALL THIRD PARTIES THAT PROVIDE CONTENT, INFORMATION OR SERVICES FOR THE WEB SITE, HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, SUITS, DEMANDS, PROCEEDINGS, LIABILITIES, LOSSES, DAMAGES, COSTS AND EXPENSES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO REASONABLE ATTORNEYS' FEES AND DISBURSEMENTS, COURT COSTS OR ARBITRATION COSTS MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR USE OF THE WEB SITE.

Termination:

Stayoo may terminate your access to and use of the Web Site, or any part thereof, with or without notice.

Stayoo Ownership and Intellectual property rights:

Ownership, Intellectual property rights of the technology, application, solution, content of any type and logo’s used on this website and any other part and parcel of Stayoo business is exclusively owned by Stayoo, respective partners and service providers, including the patents, trademark, design and copyrights.

Visitors, Guests, Hosts shall not use, copy, transfer or misuse any of the above intellectual rights in whatsoever manner unless taken prior permission from Stayoo authorities.

Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights.
